Outside Dáil Eireann, Kevin Tracey continues his struggle for justice

Every week people ask "Why is this happening in Ireland?"

On Wednesday,28 September, 2011, in glorious sunshine, the general public, visitors , passers-by and further members of the Oireachtas were leafleted and informed of the Kevin Tracey case when, despite illness, he again protested outside Dail Eireann with two new posters.

Tthere was increased interest from members of the Oireachtas and of the public inthe ongoing protest outside the Dáil. Hundreds of leaflets were handed out at the Gates and along the street.

Among the very sympathetic Oireachtas members who listened and spoke with Kevin were Joanna Tuffy, TD, Tommy Broughan TD, Emmet Stagg, TD, Joe Costello, TD, Joe Higgins, TD, Jonathan O'Brien, TD, Willie O'Dea,TD,

Among those who received the explanatory leaflet but passed on without a comment were Tanaiste Éamon Gilmore, TD, Pat Rabbitte, TD, Ruairi Quinn, TD,

Mícheál Martin TD was rushing but stopped for a very short while. Luke Ming Flanagan TD said he had no time to listen.

The leaflet handed out explained the scandal of the Kevin Tracey story from the very beginning when his legally obtained planning permission was taken away (in the year 2000) after his neighbour, now a Circuit Court Judge, objected late; through the 31 malicious summonses which he had to fight in the District courts; to his sudden illness last year and the subsequent striking out of all the remaining cases he had prepared against the State.

The leaflet and verbal reports also told of the beating up he got in the Bridewell, the early morning entry by Gardaí to arrest him in his home, the arrest and imprisonment by Gardaí of his McKenzie friend during a break in the hearing of one of his cases, the back-dating of a High Court Order by a member of the Courts Service which prevented him from appealing another High Court ruling to the Supreme Court, and innumerable instances of attempts by the members of the Courts and Courts Service and Garda authorities to pervert the course of justice.

Kevin is asking that whistleblowers from within the Garda, the Courts Service, the Judges and the legal profession come forward and testify to the corruption which they know has happened in his case.

Many passers-by who read the leaflet were genuinely shocked. Their number increases weekly.

Kevin protested again while sitting in the same place outside the Houses of the Oireachtas Wednesday, 5 October 2011. He remains ill and under doctor's orders.

Among those who were spoken to by Kevin Tracey or his supporters on 5 October were: Junior Minister Sean Sherlock,, Charlie Flanagan, TD, Derek Keating,TD, Billie Kelleher, TD, Minister Joan Burton, TD, Ken Murray (RTE), John Drennan (Sunday Independent journalist), Michael Healy Rae (who later posted on Kevin's website),Stepehen O'Brien, formerly of the PDs (who declined to talk to Kevin), Mattie McGrath (who spoke at length and sympathetically) and a very intelligent law student from Trinity College, Alan, who expressed genuine interest and shock. Maybe a future generation of judges will have lower salaries but a higher degree of integrity than many of the present lot.

As usual, members of the general public, including also many tourists both native and foreign, had the time and patience to listen carefully to us and to read the leaflets that were handed out.

Kevin Tracey will again sit at the Dáil gates today, Wednesday, 12 October 2011. As he cannot get justice from the courts, he wants to let the world know what is happening in the Irish judicial system.

Today I listened on Morning Ireland to a barrister as he piously defended the "separation of the judicial and legislative systems" as an argument against the forthcoming referendum to reduce judges' pay.

But Kevin Tracey must wonder "What separation?". When Kevin tried to prosecute THE STATE for gross wrongdoing against him and had his cases ready to be heard before juries, a senior member of THE JUDICIARY struck out six of theses cases because Kevin was ill, unable to prosecute and under doctor's orders not to do so. The President of the High Court spared the blushes and most probably the pockets of the State by rejecting outright the doctor's detailed certificate , by removing Kevin's cases from the lists - striking them out in fact before they came to court - AT THE REQUEST OF THE STATE SOLICITOR.

Is it the case that the Separation doctrine is there only when it suits one or other of the two parties, The State or the Judiciary?
