Human rights groups on European ruling on Patrick Finucane investigation

UK: Human rights groups welcome European ruling on Finucane case

Amnesty International, British Irish Rights watch, and the Committee on the Administration of Justice today welcomed the ruling of the European Court of Human Rights in the case of Patrick Finucane.

The European Court of Human Rights found that Patrick Finucane's right to life, which is protected under Article 2 of the European
Convention on Human Rights, had been violated in a number of ways:

- The RUC, who were suspected of issuing threats against Patrick Finucane, were not sufficiently independent to conduct an effective investigation into the murder. The Court concluded that there were "serious doubts as to the thoroughness or effectiveness with which the possibility of collusion was pursued." The Court observed that, "as later events were to show however, there were indications that informers working for Special Branch or the security forces knew about, or assisted in, the attack on Patrick Finucane."
- The inquest, which had refused to accept evidence of threats made against Mr. Finucane, "failed to address serious and legitimate concerns of the family and the public and cannot be regarded as
providing an effective investigation into the incident or a means of identifying or leading to the prosecution of those responsible."
- The Court criticised the DPP for failing to give reasons for the many decisions taken in relation to cases touching on the murder. The
Court noted that where the police investigation is itself open to doubts about its independence, "it is of increased importance
that the officer who decides whether or not to prosecute also gives an appearance of independence in his decision-making." They
found, "notwithstanding the suspicions of collusion however, no reasons were forthcoming at the time for the various decisions not to
prosecute and no information was made available either to the applicant or the public which might provide re-assurance that the rule of law had been respected. This cannot be regarded as compatible with the requirements of Article 2..."
- While Stevens 1 and 2 apparently did not focus on the Finucane case, in any event the reports were never made public and the Finucane family were never informed of their findings, "the
necessary elements of public scrutiny and accessibility of the family are therefore missing."
- The Stevens 3 investigation, coming some ten years after the murder, "cannot comply with the requirement that effective investigations be commenced promptly and conducted with due
expedition. It is also not apparent to what extent, if any, the final report will be made public, though a summary overview has recently
been published."

The European Court of Human Rights oncluded, "the Court finds that the proceedings for investigating the death of Patrick Finucane
failed to provide a prompt and effective investigation into the allegations of collusion by security personnel. There has consequently been a failure to comply with the procedural obligation imposed by Article 2 of the Convention and there has been, in this respect, a violation of that provision."

The human rights groups call on the government to take immediate action to give effect to the judgment of the Court. The organizations also call on the government:

- To publish the reports of Stevens 1, 2 and 3.
- To ensure that the DPP gives full reasons for the many controversial decisions that have been made in relation to the Finucane case, and
- Most important of all, to immediately establish an independent, international public inquiry with full judicial powers of discovery
and subpoena. As the European Court itself notes, international standards suggest that "in cases where government involvement is suspected, an objective and impartial investigation may not be
possible unless a special commission of inquiry is
established..."

A spokesperson for the three groups said, "this judgment confirms that there has been no effective investigation of the collusion in this murder. The Finucane family have been waiting
fourteen years for justice. It is time the government stopped aiding and abetting those who have engaged in collusion and cover-ups, and
allowed the full truth to be told about this case by establishing a
public inquiry."

If there are any trolls on Indymedia then it is the SP members. They are trying to rewrite history on an ongoing basis. Its here on Indymedia - leading members of the SP defending the SP action in QUBSU.

With the SP only the future is certain, their past is constantly changing.

Oh look it's Magneto/Durruti/Pat diverting a thread with their usual attacks on the SP! Looks like they didn't even bother to check if there was any truth to their smears! Well paint me brown and call me a turd what ever will happen next?

An anonymous member of the SP comes to wield the ultimate weapon of history rewrites - the airbrush of Stalin! Lokk this happened, the SP cannot change history unless you have a time machine.

Records would be held in QUeens which back this up. When the debate took place here, it went on for quite a while. The SP members, including leaders, doggedly defended what had happened in queens.

HOW COME THEY DIDNT TRY TO DENY IT THEN? BECAUSE QUB STUDENTS WERE ONLINE BACKING UP THE TRUE VERSION!

Now months later, the SP think they can get away with changing history.

This posting is utter nonsense. No member of the Socialist Party in Queens opposed Bursary being named after Pat Finucane or supported it being named after a Unionist, or supported the Territorial Army have a stall on freshers day. The original postings in relation to this were put up by republicans attempting to cause mischief and they have succeeded. These claims are shown up for what they are - nonsense - by the fact that the member of the Socialist Party concerned didn't even have the right to vote on any of these issues!
And before you say it - if members of the Socialist Party have put up postings which conflict with this information then they were wrong and weren't qualified (i.e. didn't have the facts) to comment on these matters.

Its true. The SP also supported the British Army having a recruiting stall at QUB.When a catholic woman motorist who was under attack by a loyalist lynch mob defended herself by running over a 16 year old UDA member, Brian Cahill of the SP accused her of murdering a child. The SP also put out a leaflet about this calling the womans act of self defence sectarian.

A ctholic was stabbedin the back in Coleraine yesterday. The SP will probably demand that he be cxharged with carrying a concealed weapon.

hs-sp,

Your religion isn't the issue here. Actions taken by your party at QUB (and more generally your attitude in the North) are. If the SP actually did criticize the SWP for supporting the Harryville parishioners, you can go fuck yourself. I was never a fan of the SP before, but if this true, you should all be fucking ashamed of yourselves.

And don't give us this "get off your computers" shit. You SP motherfuckers spend at least as much time on Indy as everyone else. And why can't you respond on Indy? Maybe because it would be on the record for everyone to see?

You sectarian (in both senses of the word) fuckheads.

I'll offer odds that the "Socialist" Party will put a spin on this or will deny that it ever occurred. A couple of weeks ago Oisin did just that - claimed that it never happened! He had actually supported the QUB SP at the time of the vote! Brassnecks isnt the word for the SP.

Where are Oisin and Finghin? Have the Troika ordered them to stay off Indymedia because of the embarassment they were causing to the SP?

Something else to bring to the attention of the voters of Blanchardstown and Swords and the media. I would relish listening to the SP defending their position on the QUB Bursary, trying to avoid answering the question but not being able to escape from David Hanley on Morning Ireland.

Its about time the SP copped themselves on about what constitutes sectarianism in the North. To them calling the bursary after Finucane would be sectarian but Finucanes murder was not!

Its an all too familiar story, when the SWP organised a counter picket against the loyalist bigots who were besieging Harryville Church, the SP condemned the SWP action as being sectarian.

author by Magnetopublication date Thu Jul 03, 2003 11:11author address author phone Report this post to the editors

At a SU Executive meeting the SP opposed naming a Bursary after Pat Finucane on the basis that it would be sectarian.* Subsequently on Indynedia, other SP members defended this stance.

Do the SP think these reports are sectarian or do they finally accept that Pat Finucane was innocent and was murdered because of his activities as a Human Rights Lawyer? Do the SP now accept that they were wrong to oppose naming the bursary after Pat Finucane?

* To add insult to injury. the SP then went on to support naming a Bursary after a Unionist who had been killed by the IRA. For some odd reason, this was not sectarian.
