The Israeli commando assault on a flotilla bringing aid to Gaza which killed at least nine civilians should be a wake-up call for those who want to believe that Prime Minister Bibi Netanyahu’s government is capable of making rational decisions. The flotilla, consisting of nationals from as many as twenty countries, was unarmed and carrying relief supplies that had been carefully inspected by the Turkish authorities. It was in international waters when it was attacked. More than 600 passengers and crew, apart from those who were killed, were subsequently arrested by Israel for refusing to identify themselves. If all that is correct, then Tel Aviv is guilty of piracy, kidnapping, and murder while the armed attack on a Turkish flagged vessel might be construed as inviting a military response from NATO. One of the vessels bore an American flag and there were at least eight US citizens on board, including a former ambassador and a USS Liberty survivor, suggesting that a strong reaction from Washington would not be inappropriate

The Legal Position on the Israeli Attack

A word on the legal position, which is very plain. To attack a foreign flagged vessel in international waters is illegal. It is not piracy, as the Israeli vessels carried a military commission. It is rather an act of illegal warfare.

Because the incident took place on the high seas does not mean however that international law is the only applicable law. The Law of the Sea is quite plain that, when an incident takes place
on a ship on the high seas (outside anybody's territorial waters) the applicable law is that of the flag state of the ship on which the incident occurred. In legal terms, the Turkish ship was Turkish territory.

There are therefore two clear legal possibilities.

Possibility one is that the Israeli commandos were acting on behalf of the government of Israel in killing the activists on the ships. In that case Israel is in a position of war with Turkey, and the act falls under international jurisdiction as a war crime.

Possibility two is that, if the killings were not authorised Israeli military action, they were acts of murder under Turkish jurisdiction. If Israel does not consider itself in a position of war with Turkey, then it must hand over the commandos involved for trial in Turkey under Turkish law.

In brief, if Israel and Turkey are not at war, then it is Turkish law which is applicable to what happened on the ship. It is for Turkey, not Israel, to carry out any inquiry or investigation into events and to initiate any prosecutions. Israel is obliged to hand over indicted personnel for prosecution.

This reminds me of Cato’s line from the series Rome, “So, this is not a humiliating defeat at all, but rather a rare species of victory!” Count me as part of the “counterproductivity corps” if you like, but if this is what Israeli victory looks like they will not be able politically to endure many more such victories. Up to a point, Israel can keep acting with impunity regardless of what the rest of the world says as long as the U.S. continues to back it. However, at some point Israel will alienate enough other U.S. allies in sufficiently provocative ways that the U.S. will have to start choosing between keeping on good terms with those other allies or continuing to back Israel uncritically and automatically.

The forged passports connected to the Dubai assassination badly damaged Israel’s relations with a number of European and other Western governments, and this has wrecked relations with Turkey. Israel is fast running out of friends to betray. Turkish FM Davutoglu has said that his government expects America to show solidarity with Turkey. He is going to be disappointed, and Turkey’s alliance with the U.S. is going to become so unpopular that we have to start wondering how long it will last. In case anyone has missed it, U.S.-Turkish relations were already fairly poor before this, and the administration’s sorry response to this attack has only worsened matters after it had earlier slapped down the Tehran nuclear deal. The chasm widening between Washington and Ankara is temporarily useful to Israel, but ultimately it is going to start showing people in Washington that the price for automatically backing Israel is not worth it.

It has become clear to me that the REAL anti-semites are the Israeli Zionists themselves - they truly hate any jewish person who opposes them - look at what happened to Goldstone, and he was a Zionist. The language they use to describe Jewish people that live outside of Israel is identical to that used by the Nazis.

The scene near the end where they take the kids to Auschwitz just looks to me like a form of torture to be honest - deliberately traumatising the kids to make them believe that everyone hates them - at one point one of the locals tries to interact with them in a very friendly way and they just presume that he's calling them 'dirty jews' because that is what they have been told - the indoctrination the kids receive seems eerily reminiscent of what i expect Nazi-era German kids went through

Erol Demir, another activist on the Mavi Marmara, said they had footage of the chaos and the carnage on the ship, emphasizing that the footage will show the real face of Israeli solders to the entire world. “They even shot those who surrendered. Many of our friends saw this. They told me that there were handcuffed people who were shot.” All activists stated that Israeli helicopters sprayed cold seawater onto the ship for three hours.

Activist Özlem Şahin Ermiş said 60 soldiers took her hostage. The prisoners were harassed by violent attack dogs and some were badly bitten. She also noted that they were not fed any food or given anything to drink during their initial interrogation on the ship.


The Nazis in the camps also used dogs and also often set them upon helpless captives

he asserted that the Israelis opened fire as they were boarding the vessel, and that one passenger took a bullet through the top of his head. Many passengers have now confirmed that they were fired on even before the commandos had boots on the deck. Presumably it is this suppressive fire that killed or wounded some passengers and which provoked an angry reaction and an attack on the commandos.

Soon after the commandos landed on the Mavi Marmara, the Turkish ship carrying more than 600 of the activists, the live satellite broadcasts from the vessel were cut. From that point on, the Israeli authorities seized almost complete control of how evidence of what was taking place could be made public. Video of the last footage broadcast by the journalists on board was immediately available from sources such as al-Jazeera and the IHH (the Turkish Foundation for Freedoms and Human Rights and Humanitarian Relief), but it showed a very confusing picture: there were badly injured passengers, yet it was impossible to know how they had been injured.

What the world has been watching since then is either edited video shot by the Israelis or other video shot by activists, confiscated by the Israelis and subsequently edited and made available through Israeli sources.

In an operation reminiscent of the first week or so of the Israeli offensive against Gaza in winter 2008-2009, the Israeli PR machine succeeded in getting the major news outlets to focus on its version of events and to use the Israeli authorities' discourse for a crucial 48 hours. (One example of how this was being done is a leaked, sophisticated briefing paper with key talking points, compiled using official government sources and pro-government Israeli media, issued through the World Zionist Organisation on 1 June.)

Israel admits that audio was not from Mavi Marmara.

"This transmission had originally cited the Mavi Marmara ship as being the source of these remarks, however, due to an open channel, the specific ship or ships in the “Freedom Flotilla” responding to the Israeli Navy could not be identified. During radio transmissions between Israeli Navy and the ships of the “Free Gaza” Flotilla on 31 May 2010, the Israeli Navy ship attempts to make contact with the ‘Defne Y’ on channel 1-6. Other ships from the flotilla respond on the channel, without identifying themselves."

On June 4, the IDF released apparently doctored audio of its exchange with the Mavi Marmara. The clip the IDF released featured the same imagery from its previous clip, but the voice of the Israeli Navy dispatcher was dramatically different. And the reply from the Mavi Marmara sounded like an impersonation of an Arab by a mentally challenged Israli pre-adolescent (both videos are still on the IDF’s YouTube channel even though they completely contradict each other).

Further, the IDF is claiming its “Aushwitz” audio is from the Mavi Marmara. Yet it includes a recording of Huwaida Arraf saying “we have permission from the Gaza port authority to enter.” Huwaida has confirmed to the Institute For Middle East Understanding that her voice appeared in the apparently doctored clip. Unfortunately for the IDF, Huwaida was on the Challenger One, not the Mavi Marmara.

How can the IDF account for this inconvenient discrepancy?

he IDF’s propaganda is getting stupider and stupider, and the media is enthusiastically playing along. This audio, which purports to show flotilla passengers telling the IDF to “go back to Auschwitz,” appears to have been doctored by the rosh katan at the IDF General Press Office.

The clip originally released by the IDF on May 31 of its exchange with the Mavi Marmara, which is featured below, shows the IDF warning the ship’s crew, “Mavi Marmara, you are appproaching an area of hostility which is under a naval blockade. The Gaza area coastal region and Gaza harbor are closed to all maritime traffic…” The Mavi Marmara responded to the IDF’s warning: “Negative, negative. Our destination is Gaza. Our destination is Gaza.” There was no reference to Auschwitz in the video the IDF released on May 31.

RTE Radio broadcasts have been blocked out from 10:00hrs to 17:00hrs for the past three days in some areas of the country. Podcasts of Today with Pat Kenny have been mostly blocked too, especially when they concern Isreals Piracy.
